§ 1 Scope and Provider

(1) The General Terms and Conditions (hereinafter referred to as "GTC") govern the contractual relationship between Dhanya Ma (hereinafter referred to as the Provider) and you (hereinafter referred to as the Customer), in their version valid at the time of the contract conclusion.

(2) Deviating terms and conditions of the Customer are rejected. Please read these conditions carefully before using any service
provided by Dhanya Ma.

(3) On Yoga & YummyEnergy, we offer you the following services: Online and Offline Yoga Workshops, Yoga Retreats, Nutritional Counseling, Cooking Classes, and Online Yoga & Nutrition Courses.

§ 2 Conclusion of the Contract

(1) Contracts on this portal can be concluded in German and
English.

(2) The Customer must be at least 18 years old.

(3) Access to the use of the Yoga & YummyEnergy servicerequires registration.

(4) By registering, the Customer accepts these GTC. Registration creates a contractual relationship between Yoga & YummyEnergy
and the registered Customer, governed by these GTC.

(5) The presentation of the service on the website does not constitute a legally binding offer. By presenting the service, the Customer is
merely invited to make an offer.

(6) By ordering a paid service, the registered Customer enters into an additional contractual relationship with Yoga & YummyEnergy,
separate from the registration. The Customer will be informed about the respective paid service and the payment terms before the conclusion of this
contractual relationship. The contractual relationship is established when the Customer confirms the order and payment obligation by clicking the "order with obligation to pay" button.

(7) You agree to receive invoices electronically. Electronic invoices will be made available to you via email or in the customer account of the website. We will inform you for each service whether an electronic invoice is available. Further information on electronic invoices can be found on our
website.

§ 3 Description of the Scope of Services

The scope of services of Yoga & YummyEnergy includes the following: Online and offline workshops and retreats, as well as counseling on the topics of Classical Hatha Yoga by Sadhguru and Yogic Nutrition.

§ 4 Prices

(1) Registration is required to use Yoga & YummyEnergy.

(2) If the user wishes to use a paid service, they will be informed about the costs beforehand. In particular, the additional scope of services, the costs incurred, and the payment method will be explained.

(3) The Provider reserves the right to charge different fee models for different booking times and user groups, as well as for different usage periods, and to offer different scopes of services.

§ 5 Payment Terms

(1) Any applicable fee is to be paid in advance, at the time of due date, without deduction, to Yoga & YummyEnergy.

(2) Certain payment methods may be excluded by the Provider in individual cases.

(3) The Customer is not allowed to pay for the service by sending cash or checks.

(4) If the Customer chooses an online payment method, they authorize the Provider to collect the amounts due at the time of the order.

(5) If the Provider offers payment by advance payment and the Customer chooses this payment method, the Customer must transfer the invoice amount to the Provider's account within five calendar days after receipt of the order.

(6) If the Provider offers payment by credit card and the Customer chooses this payment method, they expressly authorize the Provider to collect the amounts due.

(7) If the Provider offers payment by direct debit and the Customer chooses this payment method, the Customer grants the Provider a SEPA
basic mandate. In the event of a chargeback of a payment transaction due to insufficient funds or incorrect bank details provided, the Customer shall bear the costs incurred.

(8) If the Customer is in default of payment, the Provider reserves the right to claim damages for default.

(9) Payment can be made via the following methods: - PayPal - Credit card - Gift card

§ 6 Registration and Termination

(1) The Customer further declares that they, and to their knowledge, no member of their household has been convicted of a deliberate crime that endangers the safety of others, particularly not of a crime against sexual self-determination (§§ 174 ff. StGB), a crime against life (§§ 211 ff.
StGB), a crime against physical integrity (§ 223 ff. StGB), a crime against personal freedom (§§ 232 ff. StGB), theft and embezzlement (§§ 242 ff. StGB),
robbery and extortion (§§ 249 ff. StGB), or drug abuse.

(2) A user is entitled, subject to reservation, to deregister at any time without giving a reason, in writing by post, email, or telephone. At the same time, there is the option to deactivate the user account completely and independently within the data and settings in the user account.
The previously concluded contractual relationship is thereby terminated.

(3) If a user has registered for a paid service, they may terminate it no later than 30 days before the booking period. If this period is not observed, the paid service will be extended by the selected booking period, and the termination will only become effective at the end of the subsequent booking period. Termination can be made by telephone, email, or letter and will be confirmed by us in writing. To ensure that your termination can be assigned,
please provide your full name, the email address on file, and the customer's address. In the case of termination by telephone, the individual telephone
password will be required.

(4) Yoga & YummyEnergy may terminate the contract at its discretion, with or without prior notice, and without stating reasons, at any time. Yoga & YummyEnergy also reserves the right to remove profiles and/or any content published on the website by or on behalf of the user. If Yoga & YummyEnergy terminates the user's registration and/or removes profiles or published content of the user, Yoga & YummyEnergy is under no obligation to inform the user about the termination or removal or the reasons for it.

(5) Following the termination of any individual use of the Yoga & YummyEnergy services, Yoga & YummyEnergy reserves the right to
send information about this to other registered users whom Yoga & YummyEnergy believes have been in contact with the user. Yoga &
YummyEnergy's decision to terminate the user's registration and/or to inform other users with whom Yoga & YummyEnergy believes the user was in contact does not imply or state that Yoga & YummyEnergy makes any statements about the individual character, general reputation, personal characteristics, orlifestyle.

(6) Users are required not to make any intentional or fraudulent misrepresentations in their profile or other areas of the portal.
Such information may result in civil action. The operator also reserves the right to terminate the existing contractual relationship with immediate effect in such cases.

(7) If a user's access is blocked due to a culpable breach of contract and/or the contractual relationship is terminated, the user shall pay compensation for the remaining contractual term in the amount of the agreed fee minus the saved expenses. The amount of the saved expenses is set at a flat rate of 10% of the fee. Both contractual parties remain free to prove that the damage and/or saved expenses are actually higher or lower.

(8) Upon termination of the contractual relationship, all data of the user will be deleted by Yoga & YummyEnergy.

§ 7 Limitation of Liability (Services)

(1) Yoga & YummyEnergy assumes no responsibility for the content and accuracy of the information in the registration and profile data of
the Customers, as well as other content generated by the Customers.

(2) With regard to the requested or offered service, the contract is concluded exclusively between the respective participating Customers. Therefore, Yoga & YummyEnergy is not liable for the services provided by the participating Customers. Accordingly, all matters relating to the relationship between the Customers, including, without limitation, the services a seeker has received or payments due to Customers, must be addressed directly to the respective party. Yoga & YummyEnergy cannot be held responsible for this and expressly disclaims any liability of any kind, including claims, services, direct or indirect damages of any kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, in any way related to such matters.

(3) Dhanya Ma is only liable for damages resulting from injury to life, body, or health if these are based on an intentional or negligent breach of duty by Dhanya Ma or an intentional or negligent breach of duty by a legal representative or vicarious agent of Dhanya Ma.

(4) For other damages, insofar as they are not based on the breach of cardinal obligations (such obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely), Dhanya Ma Europe is only liable if these are based on an intentional or grossly negligent breach of duty by Dhanya Ma or on an intentional or grossly negligent breach of duty
by a legal representative or vicarious agent of Dhanya Ma.

(5) The claims for damages are limited to the foreseeable, contract-typical damage. In the event of default, they amount to a maximum of
5% of the order value.

(6) Claims for damages based on injury to life, body, or health or freedom are subject to a statute of limitations of 30 years; otherwise, they are subject to a statute of limitations of 1 year, with the statute of limitations beginning at the end of the year in which the claim arose and the creditor became aware or should have become aware of the circumstances giving rise to the claim and the debtor (§ 199 para.1 BGB).

(7) The Provider reserves the right to review the content of any text written.
